Do you qualify under the new route the UK for BNO passport holders?
Firstly, you need to be in the UK, or ordinarily resident in Hong Kong.
When can I apply?
You can’t apply until after 31 January 2021 for permission to stay in the UK under this route, however, if you current permission to stay is due to expire before the end of January, you can apply for an extension outside the Immigration Rules.
How long can I stay for?
If you’re outside the UK, visas are available for 2.5 years or 5 years. The 2.5 year visas are much cheaper, so you might choose this if you are unsure about whether you want to stay in the UK. If you do decide to stay, then you will be entitled to Indefinite Leave to Remain after five years.
If you are already on a route to settlement in the UK, i.e. as a Tier 2 migrant, skilled worker, or family member, you can count your time spent in the UK towards the five years needed for indefinite leave to remain.
Who can come with me?
You can bring your spouse and children. In some circumstances you can also bring your grandchildren. You may bring adult dependent relatives in the same circumstances that a British national can. Be aware, the Rules on this are difficult to succeed under, the equivalent route for British nationals results in grant rates of under 10%.
What do I need to go ahead?
You’ll need a TB test, finances to support you and your family members who are applying with you, available adequate accommodation in the UK, evidence of your residence in Hong Kong or the UK, your BNO passport or citizen status and evidence of your relationship with your dependents.
